Terms of Service

1. Definitions

In these terms, the following definitions apply:

• "Fieldgyde", "we" or "us": the sole proprietorship Fieldgyde, registered with the Dutch Chamber of Commerce under number 53592085, located at Koolemans Beynenstraat 10, 6521EV Nijmegen, the Netherlands.
• "User" or "you": the person who creates an account and/or uses the service.
• "Service": the web application offered by Fieldgyde that enables users to generate interview scripts.
• "Script": an interview script generated by the Service.

2. Applicability

These terms apply to all use of the Service. By creating an account or using the Service, you agree to these terms.

3. Account and access

3.1 Account registration

To use the Service, you must create an account. You must be at least 16 years old to create an account. You are responsible for providing accurate and up-to-date information during registration.

3.2 Account security

You are responsible for securing your account credentials and for all activities that occur under your account. Sharing accounts with third parties is not permitted. The account holder remains responsible at all times for compliance with these terms.

4. Pricing and payment

4.1 Payment per script

The Service operates on a pay-per-generated-script basis. The current price is clearly displayed before each purchase. All prices include VAT unless otherwise stated.

4.2 Payment processing

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms and conditions. It is prohibited to pay with stolen or fraudulent payment methods.

4.3 Refunds

If the generation of a script has technically failed or if you are dissatisfied with the result, you may request a refund within 14 days of purchase by contacting us. We aim to process refund requests within 5 business days.

4.4 Disputes

In case of payment disputes, we kindly request that you contact us directly before filing a dispute with your bank or credit card company. This allows us to resolve any issues quickly and to your satisfaction.

5. Intellectual property

5.1 Ownership of generated scripts

The scripts you generate are your property. You are free to use, modify and share these scripts as you see fit.

5.2 Ownership of Fieldgyde

The underlying technology, methodology, prompts, interface and all other components of the Service remain the property of Fieldgyde. Nothing in these terms grants you any rights to these components.

5.3 Use for improvement

Fieldgyde may use the information you enter and the generated scripts in anonymized form to analyze and improve the Service.

6. User responsibilities

6.1 Content of input

You are responsible for the information you enter when generating scripts. If your input infringes on the copyrights or privacy of third parties, you are liable for this. Fieldgyde is not responsible for the content of your input.

6.2 Use of scripts

The generated scripts are tools that support you in preparing user research interviews. The scripts do not guarantee successful research outcomes. Successfully conducting interviews requires skills and experience from the interviewer. We recommend that you further develop your expertise in UX and Product Research by reading professional literature and gaining practical experience.

6.3 Assessment of output

It is your responsibility to assess the generated scripts for suitability and accuracy for your specific situation before using them.

6.4 Prohibited use

It is not permitted to:

• Use the Service in a way that disrupts or overloads its operation.
• Use automated systems or software to collect data from the Service without our written permission.
• Attempt to gain unauthorized access to Fieldgyde's systems or networks.
• Use the Service to generate scripts with unlawful, discriminatory or misleading content.

7. Liability

7.1 Service provided 'as is'

The Service is provided 'as is', without warranties regarding availability, accuracy or fitness for a particular purpose. Fieldgyde makes no guarantees about uptime or uninterrupted access to the Service.

7.2 Limitation of liability

Fieldgyde is not liable for indirect damages, consequential damages, lost profits or missed savings. Fieldgyde's total liability is limited to the amount you paid for the relevant transaction.

7.3 Inaccurate output

The Service uses AI technology. Fieldgyde is not liable for inaccuracies in the generated scripts. If you believe a script is inaccurate or unsuitable, you may request a refund in accordance with article 4.3.

8. Privacy and data

8.1 Data processing

Fieldgyde processes personal data in accordance with the General Data Protection Regulation (GDPR). See our Privacy Policy for more information on how we handle your data.

8.2 Data storage

Your entered information and generated scripts are stored as long as your account is active. Upon termination of your account, your scripts are immediately and permanently deleted. Anonymized metadata (such as evaluation scores) may be retained for analysis and improvement of the Service in accordance with article 5.3.

8.3 Sub-processors and AI services

Fieldgyde uses external AI services (such as large language models) to generate scripts. Fieldgyde reserves the right to use different AI models and providers at its discretion, with the aim of ensuring the best possible quality of the Service. Your entered data may be processed by these external services in accordance with their respective privacy policies and our data processing agreements.

9. Termination

9.1 Termination by user

You may terminate your account at any time. After termination, your generated scripts are immediately and permanently deleted and will no longer be accessible. Payments already made will not be refunded, unless otherwise specified in article 4.3.

9.2 Termination by Fieldgyde

Fieldgyde reserves the right to suspend or terminate accounts in case of violation of these terms, fraudulent behavior, or other circumstances that we reasonably consider harmful to the Service or other users.

10. Changes

Fieldgyde reserves the right to modify these terms. Material changes will be announced at least 30 days in advance via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

11. Applicable law and disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands. For consumers within the EU, the mandatory provisions of consumer law of their country of residence additionally apply.
